Terms of Use

1. Acceptance of terms
By creating an account or using the Gradeio service at gradeio.ie (“the Service”), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Service.
These terms constitute a legally binding agreement between you and Gradeio (“we”, “us”, “our”). We reserve the right to update them at any time. We will notify registered users of material changes by email. Continued use after notice constitutes acceptance.
2. Who may use Gradeio
The Service is intended for use by educators — primarily secondary school teachers in Ireland — for formative assessment purposes. To use the Service you must:
- Be at least 18 years old, or have the consent of a parent or guardian if you are aged 16–17.
- Provide accurate information during account registration.
- Comply with all applicable laws, including Irish and EU data protection law.
3. Free tier and subscriptions
- New accounts receive a limited number of free grading runs. This allowance is per account and may not be transferred or pooled.
- Additional grading capacity is available through a paid subscription. Subscription terms, pricing, and billing cycles are displayed at the point of purchase and may be updated with 30 days’ notice.
- Subscriptions auto-renew unless cancelled before the renewal date. Cancellations take effect at the end of the current billing period — no partial refunds are issued for unused time.
- We reserve the right to modify, restrict, or discontinue free-tier access at any time.
4. Acceptable use
You agree that you will not:
- Upload content that you do not have the right to share, including student work where you have not obtained appropriate consent or do not have a legitimate educational basis to do so.
- Attempt to reverse-engineer, scrape, or systematically extract data from the Service.
- Use the Service to process personal data for any purpose other than formative assessment of examination scripts.
- Share your account credentials with others.
- Use the Service to generate or distribute misleading or fabricated assessment results.
- Attempt to circumvent usage limits, access controls, or rate limits.
- Use the Service in any way that could damage, disable, or impair its availability for other users.
5. Teacher responsibility for student data
When you upload student exam work to Gradeio, you act as the data controller for that student’s personal data, and we act as a data processor on your behalf. You are responsible for:
- Ensuring you have a lawful basis to process the student’s personal data (e.g. legitimate interests as their teacher).
- Anonymising student work where practicable, particularly for students aged under 18.
- Complying with your school or institution’s data-protection policies.

6. AI grades — no official standing
Grades generated by Gradeio are produced by AI and are for formative guidance only. They do not constitute official Leaving Certificate grades. You must not use AI-generated grades as the sole basis for any high-stakes decision. See our Disclaimer for full details.
7. Intellectual property
We retain all rights to the Service, including its design, algorithms, and branding. You retain ownership of any content you upload. By uploading content, you grant us a limited, non-exclusive licence to process it solely to provide the Service to you. We do not use student exam content to train AI models.
8. Service availability
We aim to keep Gradeio available and accurate, but we do not guarantee uninterrupted access. We may perform maintenance, apply updates, or temporarily suspend the Service without notice. We will endeavour to give advance notice of planned downtime where practical.
9. Limitation of liability
To the fullest extent permitted by Irish and EU law, Gradeio shall not be liable for:
- Indirect, consequential, or incidental losses arising from use of the Service.
- Errors or inaccuracies in AI-generated grades.
- Loss of data resulting from a failure of your device or browser storage.
- Decisions made in reliance on AI-generated output.
Our aggregate liability to you for any claim arising under these terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.
10. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your account if you breach these terms, with or without notice depending on the severity of the breach. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
11. Governing law and disputes
These terms are governed by the laws of Ireland. Any dispute shall be subject to the exclusive jurisdiction of the Irish courts, unless mandatory consumer-protection rules in your country of residence give you additional rights. If you are an EU consumer, you may also use the EU Online Dispute Resolution platform.
